These Terms of Service ("Terms") govern your access to and use of INMARK (the "Site"), including any content, functionality, and services offered on or through the Site. Please read these Terms carefully before using the Site. By using the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Who We Are
INMARK designs and sells personalised, deep-engraved pet identification pendants. We are powered by Shopify, Inc., which provides the e-commerce platform that allows us to sell our products and services to you.

Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on the Site. By using the Site, you represent that you meet this requirement.

Products and Personalisation
Every pendant sold on the Site is made to order and deep-engraved with the personalisation details you provide at checkout (such as your pet's name, dates, or other custom text). You are solely responsible for reviewing and confirming the accuracy of all personalisation details, size, and metal selection before completing your order, as production begins shortly after an order is placed. Please refer to our Refund Policy for details on returns, damage, and fulfilment errors.

We make reasonable efforts to display our products, including colours, finishes, and engraving detail, as accurately as possible. However, we do not warrant that product images on your device will be entirely accurate, as actual appearance may vary depending on your screen, the selected metal, size, and engraving.

Orders, Pricing, and Payment
All prices displayed on the Site are shown in the currency applicable to your selected region and are subject to change without notice. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity. If we cancel an order after payment has been taken, we will issue a full refund.

Payment must be received in full before an order is placed into production. You agree to provide current, complete, and accurate purchase and account information for all purchases made on the Site.

Shipping and Delivery
Estimated production and delivery timeframes are provided for guidance only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs, or other circumstances outside our reasonable control.

Intellectual Property
All content on the Site, including text, graphics, logos, images, designs, and the INMARK name and branding, is the property of INMARK or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

Acceptable Use
You agree not to use the Site for any unlawful purpose, to submit personalisation content that is offensive, defamatory, or infringes on the rights of others, or to attempt to interfere with the proper functioning of the Site.

Limitation of Liability
To the fullest extent permitted by applicable law, INMARK shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of our products. Our total liability for any claim arising from your use of the Site or a purchased product shall not exceed the amount you paid for the product giving rise to the claim.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including any consumer guarantee rights you may have under the law of your jurisdiction.

The Site may contain links to third-party websites or services that are not owned or controlled by INMARK. We are not responsible for the content, privacy policies, or practices of any third-party websites or services.

Changes to These Terms

These Terms are governed by the laws of New Zealand, without regard to its conflict of law principles, except where mandatory consumer protection laws of your country of residence apply.
